Tampereen Kiipeilykeskuksen vuosijäsensopimus

Sopimusaika
Tämä sopimus on asiakkaan ja Tampereen Kiipeilykeskus Oy, 2303654-0 (myöhemmin palveluntarjoaja) välinen sopimus vuosijäsenyydestä. Asiakas sitoutuu vuoden (12kk) mittaiseen jäsenyyteen palveluntarjoajan kanssa. Sopimus on voimassa toistaiseksi. Laskutus alkaa aloituskuukaudesta, mikäli sopimus on allekirjoitettu aiemmin kuin 15. päivä kuluvaa kuuta. Muutoin laskutus alkaa seuraavan kuukauden 1. päivästä. Laskutus voi myös alkaa muutoin sovitulla tavalla esim. ennakkojäsenyys tai tarjouskampanjat.
Irtisanominen asiakkaan puolelta
Vuoden (12 kk) jäsenyyden jälkeen asiakas voi irtisanoa sopimuksen 1 kk:n irtisanomisajalla. Asiakkaan tulee ilmoittaa irtisanomisesta kirjallisesti (esim. sähköpostitse). Mikäli asiakkaalla on esittää lääkärintodistus, jonka perusteella palvelun käyttäminen estyy tai asiakas muuttaa pois Pirkanmaan maakunnasta, on asiakkaalla oikeus irtisanoa sopimus ilman sakkoa. Asiakas voi lääkärintodistuksen tai muun pätevän syyn (päätetään tapauskohtaisesti) perusteella jäädyttää jäsenyytensä vähintään kolmen (3) kuukauden ajaksi. Mikäli asiakas haluaa muutoin irtisanoa sopimuksen kesken ensimmäisen vuoden (12 kk) sopimuskauden ennen vuoden sopimusajan täyttymistä, sovelletaan 1 kk:n irtisanomisaikaa ja sakkomaksua. Sakkomaksu on yhden jäsenkuukauden hinnan suuruinen (esim. 64 €).
Irtisanominen palveluntarjoajan puolelta:
Palveluntarjoaja voi irtisanoa sopimuksen välittömästi, mikäli
1. asiakas laiminlyö sopimuksen ehtoja tai Tampereen Kiipeilykeskus Oy sääntöjä tai
2. asiakkaan vuosijäsenmaksut ovat 28 päivää myöhässä.
Asiakas voi menettää oikeuden avainlinkkiin, jos hän ei noudata kiipeilytilan sääntöjä aukiolon ulkopuolella.
Muutoin irtisanomisaika palveluntarjoajan puolelta on 1 kk.
Tilojen käyttö aukioloaikojen ulkopuolella:
Asiakas voi lunastaa avainkortin, jolla hän pääsee käyttämään keskuksen palveluja myös aukioloaikojen ulkopuolella. Keskus on asiakkaan käytössä joka päivä pois lukien erikoistapahtumat ja huoltotoimenpiteiden ajan, joista palveluntarjoaja ilmoittaa erikseen nettisivuilla http://www.tampereenkiipeilykeskus.fi ja vuosijäsenkirjeessä.
Ilmoitusvelvollisuus:
Asiakas on velvollinen ilmoittamaan yhteystietojen muutoksesta palveluntarjoajalle. Palveluntarjoaja on velvollinen ilmoittamaan merkittävästä sääntöjen muutoksesta asiakkaalle kirjallisesti (sähköpostitse). Kulloinkin voimassa olevat säännöt ovat myös luettavissa kiipeilykeskuksessa.
Kiipeily on laji, joka sisältää vakavan vamman vaaran. Kiipeily tapahtuu omalla vastuulla. Palveluntarjoajan antamia sääntöjä ja toimintaohjeita tulee noudattaa. Ajantasaiset säännöt on nähtävissä kiipeilytiloissa. Palveluntarjoaja ei ole vastuussa kiipeilyssä tapahtuneista vahingoista. Sopimus on henkilökohtainen.

Terms of Yearly membership agreement Tampere Climbing Gym (Tampereen Kiipeilykeskus)

Contract period
This agreement is between the customer and Tampereen Kiipeilykeskus Oy, 2303654-0 (later the service provider) agreement on annual membership. The customer commits to a one-year (12-month) membership of the service provider with. The contract is valid until further notice. Invoicing starts from the start month, if the contract has been signed earlier than the 15th of the current month. Otherwise, billing starts the following month from the 1st day. Invoicing can also start in an otherwise agreed way, e.g. advance membership or promotional campaigns.
Termination and “Freezing” of the membership by the customer
After a year’s membership, the customer can terminate the contract with 1 month notice period. The customer must notify termination in writing (e.g. email). If the customer has to present a medical certificate on basis of which the service
use is prevented or the customer moves out of Pirkanmaa province, the customer has the right to terminate the contract with 1 month notice period any time. The customer can also provide a medical certificate or other valid reason (to be decided
on a case-by-case basis) to freeze the membership. The shortest suspension is three months but decisions are made case by case.
If the customer otherwise wishes to terminate the contract during the first year of contract, the customer must pay a penalty fee to the service provider which is the current monthly payment of the yearly member (e.g. 64 €). One month’s notice period applies. The customer can therefore terminate the contract in the middle of the contract period, but has to reimburse the benefit received to the service provider.
Termination by the service provider
The service provider can terminate the contract immediately
- if the customer neglects the terms of the contract or Tampereen Kiipeilykeskus Oy rules
- if the membership payment is late for more than 28 days.
It is possible to lose the right to use the premises outside of opening hours with a key if the member neglects the rules that apply outside of opening hours. Otherwise, the service provider’s notice period is 1 month.
Use of the premises outside opening hours
The customer can redeem a key link with which he can use the center services also outside opening hours. The age limit for the key link is 18 yo. The customer can use the facilities every day excluding special events and maintenance announced by the service provider separately on the website http://www.tampereenkiipeilykeskus.fi and by email.
Notification obligation
The customer is obliged to notify the change of contact information to the service provider. The service provider is obliged to notify the change of the rules to the customer in writing (by e-mail). Rules in force at any given time can also be read in the Climbing Center.
Climbing is a sport that involves the risk of serious injury. Climbing is happening at your own risk. There will be rules and operating instructions given by the service provider follow. The up-to-date rules can be seen in the climbing facilities. The service provider is not responsible for damages caused while climbing. The contract is personal.
